In a twist worthy of a legal thriller, Encyclopedia Britannica and Merriam-Webster have taken OpenAI to court, accusing the AI giant of "massive copyright infringement."

The lawsuit claims that OpenAI has been scraping nearly 100,000 copyrighted articles to train its language models without permission.

Britannica alleges that OpenAI's use of its content in ChatGPT's retrieval augmented generation (RAG) workflow violates copyright laws. The RAG tool scans the web for fresh information, but Britannica argues that it reproduces their content verbatim, infringing on their rights. Additionally, Britannica claims OpenAI breaches the Lanham Act by generating false attributions, potentially misleading users.

The lawsuit highlights concerns that ChatGPT is diverting revenue from web publishers by providing users with responses that compete directly with content from sources like Britannica. Furthermore, Britannica argues that ChatGPT's "hallucinations"—incorrect or fabricated information—threaten public access to reliable online information.

Britannica isn't alone in its legal battle. Other publishers, including The New York Times and Ziff Davis, have also sued OpenAI over similar copyright concerns. A pending lawsuit against Perplexity echoes Britannica's grievances.

The legal landscape for using copyrighted content to train AI models remains murky. While a federal judge previously ruled that using content as training data can be transformative and legal, issues arise when content is acquired without proper licensing. Anthropic's case resulted in a $1.5 billion settlement for illegally downloading books.

As the courtroom drama unfolds, the outcome could set a significant precedent for the future of AI and copyright law. Stay tuned for more updates on this legal saga!
