1. Introduction
1.1 These Terms and Conditions ("T&Cs") govern the use of the Particulars Writer product ("the Product") provided by ModelProp Ltd ("the Company") to its clients ("the Client").
1.2 By using the Product, the Client agrees to be bound by these T&Cs.

2. Scope of Services
2.1 The Product is a web-based service that generates written property descriptions using artificial intelligence (AI) based on data provided by the Client.
2.2 The Product shall only be used for the purpose of creating property content.

3. Access and Use
3.1 The Client will access the Product via a dedicated URL provided by the Company.
3.2 The Client is responsible for maintaining the confidentiality of their login credentials and for any activity that occurs under their account.

4. Subscription and Payment
4.1 The Product is offered as a monthly subscription service, with two pricing tiers: Base (£49 +VAT) and Pro (£99 +VAT).
4.2 Payments shall be made in advance on a monthly basis.
4.3 Any changes to the subscriptions will be notified in writing, with at least one month’s notice.

5. Data Security and Confidentiality
5.1 The Company shall store and process all data provided by the Client in accordance with the General Data Protection Regulation (GDPR) and all other applicable data protection laws and regulations.
5.2 The Company shall implement appropriate technical and organisational measures to ensure the security and confidentiality of the Client's data.

6. Data Retention and Deletion
6.1 The Company shall retain the Client's data only for as long as necessary to provide the services and fulfil its legal obligations.
6.2 Upon termination of the service, the Company shall delete all of the Client's data within a reasonable timeframe, unless required to retain it by law.

7. Intellectual Property
7.1 The content generated by the Product is AI-generated and cannot be copyrighted.
7.2 The Client is granted a non-exclusive, non-transferable licence to use the generated content for their business purposes.

8. Customer Support
8.1 The Company shall provide customer support via email (support@modelprop.ai) and telephone (0800 861 1697).
8.2 The Company shall make reasonable efforts to respond to and resolve any issues reported by the Client in a timely manner.

9. Termination
9.1 Either party may terminate the service with one month's written notice.
9.2 The Company reserves the right to terminate the service immediately if the Client breaches any of these T&Cs.

10. Modifications to T&Cs
10.1 The Company reserves the right to modify these T&Cs at any time.
10.2 The Client will be notified of any material changes to the T&Cs and will have the opportunity to review and accept the updated terms.

11. Disclaimers and Limitations of Liability
11.1 The Product is provided "as is" without any warranties, express or implied.
11.2 The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Product.
11.3 The Company's total liability shall not exceed the subscription fees paid by the Client in the 12 months prior to the event giving rise to the claim.

12. Governing Law and Jurisdiction
12.1 These T&Cs shall be governed by and construed in accordance with the laws of England and Wales.
12.2 Any disputes arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By using the Particulars Writer product, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
